    US IEEPA Tariff Refunds - Update June 2026

    (English below) A marzo avevo parlatocon Lisa Schachne — avvocata specializzata in commercio internazionale e membro del network Legalmondo negli Stati Uniti — dei dazi IEEPA imposti dall’amministrazione Trump e delle prime contestazioni legali (link all’episodio in calce). Oggi torniamo sull’argomento perché nel frattempo è successo molto.Il 2 giugno il governo americano ha fatto appello contro l’ingiunzione che avrebbe obbligato le autorità doganali a rimborsare i dazi IEEPA. È un segnale chiaro: l’amministrazione non ha intenzione di restituire denaro volontariamente.In questo episodio Lisa spiega cosa è successo con il processo CAPE Phase 1 — il meccanismo attraverso cui alcuni importatori hanno già ricevuto rimborsi parziali, ma in molti casi ancora meno del 10% di quanto spettava loro — e soprattutto cosa devono fare adesso gli importatori che hanno crediti aperti.Tre cose da tenere a mente:* Il CAPE Phase 1 non vale per tutti. Ci sono requisiti tecnici precisi sulle entries liquidate, sui tempi di presentazione, e persino sul conto corrente bancario (deve essere americano). Chi ha presentato la domanda senza verifica professionale rischia di essere stato respinto anche se in linea di principio era eleggibile.* I rimborsi approvati sono in un limbo. Il governo non ha formalmente bloccato i pagamenti, ma di fatto non ne sta erogando di nuovi oltre al primo piccolo acconto. I filer Phase 1 che si trovano nel miglior scenario possibile — domanda corretta, conto americano, primo pagamento ricevuto — aspettano ancora la quasi totalità del credito.* Chi ha un credito rilevante è bene parlare con un avvocaato esperto, perchè la finestra si sta chiudendo. Ne riparleremo.🇺🇸 IEEPA Tariffs: What Importers Need to Know NowBack in March 2026, I sat down with Lisa Schachne — a US attorney and member of the Legalmondo network — to talk about IEEPA tariffs and the early legal challenges around them (link to the episode below). A lot has happened since then, and Lisa is back to give us the update.On June 2nd, the US government appealed the injunction that would have required customs authorities to refund IEEPA tariffs across the board. The message is clear: the administration has no intention of returning money voluntarily.In this episode, Lisa walks us through what’s happened with the CAPE Phase 1 process — the mechanism through which some importers have already received partial refunds, though in many cases less than 10% of what they were owed — and more importantly, what importers with open claims should be doing right now.Three things to keep in mind:* CAPE Phase 1 doesn’t apply to everyone. There are strict technical requirements around liquidated entries, filing deadlines, and even bank accounts — you need a US bank account to receive a refund through this process. Importers who filed without professional guidance may have been rejected even if they were technically eligible.* Approved refunds are stuck in limbo. The government hasn’t formally announced a freeze, but in practice no new payments are going out beyond the initial small batch. Even importers who did everything right — correct filing, US bank account, first payment received — are still waiting for the vast majority of their claim.* If you have a significant claim, act now. While you wait, your entries keep liquidating. Every week of delay narrows your options. Lisa is direct about this: if your claim is above half a million dollars and you haven’t spoken with a specialized trade attorney yet, the time is now — not next month.The US tariff saga is far from over.
